02Authorised activities

03Local compliance (UAE)
MyKonci complies with the main legislation applicable in the United Arab Emirates:
- UAE Personal Data Protection Law (PDPL). Federal Law No. 45 of 2021 on the protection of personal data, applicable to entities processing data of people residing in the UAE. Competent supervisory authority: UAE Data Office (Office of the Federal Data Protection Authority). MyKonci applies a unified framework aligned with the GDPR, generally more protective than the PDPL, which ensures compliance with UAE obligations. The rights of data subjects residing in the UAE (access, rectification, erasure, objection, portability) can be exercised on the same conditions as GDPR rights, by contacting privacy@mykonci.com.
- Legal bases and consent (PDPL). In line with article 4 of Federal Law No. 45/2021, MyKonci documents the appropriate legal basis for each processing operation (performance of contract, legitimate interest, legal obligation, consent). Consent for commercial purposes (prospecting) is collected explicitly, freely and revocably.
- International transfers (PDPL). Data transfers from the UAE to the European Union are made to a territory considered as offering an adequate level of protection. Transfers to the United States go via sub-processors framed by Standard Contractual Clauses and Data Privacy Framework (see privacy policy).
- UAE Cybercrime Law. Federal Law No. 34 of 2021. MyKonci prohibits any use of its platform for illegal purposes or purposes contrary to public order.
- UAE Electronic Transactions Law. Federal Law No. 46 of 2021, applicable to the signature and validity of electronic contracts.
- TDRA / TRA. Compliance with the rules relating to telecommunications and the transmission of automated messages where applicable.
- Anti Money Laundering & Terrorism Financing. Compliance with applicable AML/KYC obligations when transacting with customers.
04Relations with the European Union
Although MyKonci is a UAE entity, the majority of its customers are located in the European Union. MyKonci voluntarily and contractually applies the European legal framework, in particular:
- The General Data Protection Regulation (GDPR, Regulation EU 2016/679), with a representative in the European Union appointed in line with article 27 of the GDPR.
- The European AI Regulation (AI Act, Regulation EU 2024/1689), see the AI policy.
- The mandatory provisions of the French Consumer Code for consumer customers residing in France (Rome I Regulation).
- The P2B Regulation 2019/1150 on transparency of online intermediation services where applicable.

06Tax and invoicing
MyKonci, as an entity established in a UAE free zone, applies the corresponding tax regime:
- VAT not applicable on output for services supplied to customers outside the UAE, except for specific local provisions of the customer's country (intra-EU B2B reverse charge where applicable).
- UAE corporate tax: application of the free-zone regime for eligible activities.
- Invoices are issued by the UAE entity in EUR or USD depending on the region.

07Dispute resolution
Dispute resolution arrangements are detailed in the T&Cs of sale (article 11) and the Terms of use (articles 12-13). In summary:
- For EU consumer customers: application of the mandatory consumer law provisions of the country of residence (Rome I Regulation) and the possibility to use the European Commission's ODR platform.
- For professional customers: applicable law and competent jurisdiction as defined in the contract, by default UAE.
- Systematic search for an amicable solution before any litigation.
08Transparency
MyKonci commits to full transparency about its foreign-entity status with its European customers. All legal documents (legal notice, T&Cs of use, T&Cs of sale, DPA, Privacy, SLA, Security, AI Policy) are publicly accessible on mykonci.com.
